Terms and Conditions
The owner of the online store is HoiaMed OÜ (hereinafter referred to as the online store) is 16179745 (registry code ), located at Tatari 64, 10134, Tallinn.
The validity of contract of sale, product and price information
In the case of a private customer, the sales contract is considered concluded and the execution of the order begins immediately after the Customer has paid 100% of the order confirmation.
In case of medical institutions, the sales contract is considered concluded and the execution of the order starts immediately after the Customer has submitted his order, either by phone or e-mail and has also received confirmation from HoiaMed OÜ authorized representative.
The prices of the products sold in the online store are indicated next to the products. A fee for shipping is added to the price.
The shipping cost depends on the location of the purchaser and the shipping method. The shipping cost is displayed when the purchaser places the order.
All prices are in Euros (€).
Product information is provided immediately adjacent to the product in the online store.
Placing an order
Add the desired products to your shopping basket to order them. Fill in all of the required fields and choose the most suitable shipping method to complete the order. The total cost is then displayed on the screen. This can be paid securely via the following payment methods provided by Maksekeskus AS:
- Estonian bank links: Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay and Citadele.
- Visa / MasterCard credit card payments
NB! When using a bank link payment confirm the order and then click on the ‘Return to merchant’ button.
The personal data necessary for the execution of payments is transferred to authorized processor Maksekeskus AS. The contract enters into force when the amount payable is transferred to the bank account of the online store.
If we cannot deliver the ordered products due to stock running out or for any other reason, the purchaser will be informed as soon as possible and the money paid (including the shipping cost) will be refunded promptly, but no later than within 14 days of receiving the notification.
After the purchase the contract enters into force, HoiaMed OÜ will complete the order and hand it over to our logistics partners for delivery.
Our Logistics partners are: Itella Smartpost , Omniva and DPD.
Product delivery times are different and are displayed under each product of the www.hoiamed.ee e-store separately. If you order by phone or e-mail (firstname.lastname@example.org), you will receive information about delivery times from HoiaMed OÜś represenative.
Standard delivery time is: 3-4 workdays. If the product is not in our stock, than HoiaMed OÜ will inform the customer about the delivery time (maximum delivery time up to 20 workdays.
If Customer orders several products, the delivery time will be based on the product with the longest delivery time (if not agreed otherwise in the written manner through cusotmer support email@example.com).
The Customer is obliged to notify HoiaMed OÜ of any change in the destination or agreed time as soon as possible before delivery of the products.
The avoidance of delays and misunderstandings in the delivery of products depends on the accuracy and correctness of the information provided in the order. HoiaMed OÜ is not responsible for delays in the delivery of products and misunderstandings if the delay or misunderstanding is due to the inaccuracy of the data provided by the Customer when placing the order.
Shipments that have been damaged during transport where the products, but not the product packaging, have been damaged will be replaced by the Customer. If you have received a defective or incomplete product, please do not use it and notify HoiaMed OÜ immediately. If replacement proves impossible, we offer either an alternative product or compensation for the cost of the damaged products.
All shipments within Estonia generally arrive at the destination specified by the purchaser within 2-3 business days of the date of entry into force of the contract of sale. All shipments outside of Estonia, will be specified with the Customer.
Right of withdrawal
After receiving the order, the purchaser has the right to withdraw from the contract entered into with the e-store within 14 days.
Exception: The purchaser has no right to withdraw products, which are packed in the sterile package – if the inner sterile package is damaged, and it is not caused by HoiaMed OÜ.
The right of withdrawal does not apply if the purchaser is a legal person. To exercise the 14-day right of withdrawal, you must not use the ordered products in any way other than is necessary to ensure the nature, characteristics, and functioning of the products in the same way you would be allowed to test the products in an actual store.
If the products have been used for any purpose other than is necessary to ensure the nature, characteristics, and functioning of the products, or if there are any signs of use or wear and tear, the online store has the right to lower the amount returned in accordance with the decrease in the value of the products.
To return the products, you must submit a return application (a free-form text ) to firstname.lastname@example.org within 14 days of receiving the products. The return application must include the Customer’s name, the name of the product and the invoice or order number and the reason why the Customer wishes to return the product.
The purchaser shall bear the cost of returning the products, except in cases where the reason for the return lies in the fact that a refundable product does not comply with the order (e.g. a wrong or defective product).
The purchaser must return the products within 14 days of the submission of the return application or submit evidence that they handed over the products to the carrier within the aforementioned period.
Upon receiving the returned products, the online store shall return to the purchaser, immediately but no later than after 14 days, all of the payments received from the purchaser based on the contract.
The online store has the right to refuse to make a refund until the products being returned are received or until the buyer has provided proof of returning the products, whichever occurs first.
If the buyer has clearly chosen a different form of shipment than the cheapest usual form of shipment offered by the online store, the store is not required to compensate the cost exceeding the usual shipping cost.
The online store has the right to withdraw from the sale and demand that the products be returned by the purchaser if the marked price of the products in the online store is significantly lower than the market price of the products due to an error.
Procedure for submitting claims
Pursuant to the Law of Obligations Act, the Customer has the right to file claims for non-compliance with the terms and conditions of the product within 2 years from receipt of the products.
If a product defect occurs, the Customer undertakes to immediately notify HoiaMed OÜ of the problem at the e-mail address email@example.com and provide the following information: name, contact information and product defect, if possible also include the order or invoice number and a picture or video. The use of a defective product must be stopped immediately and the Customer must not start repairing the product himself. If the Customer has in any way changed or repaired the defective product, the Seller has the right to refuse to take back the product.
HoiaMed OÜ is not responsible for:
- Damage to the product caused by the customer’s fault or negligence (eg misuse of the product, non-maintenance, etc.).
- Defects caused by improper use of the product.
- For the natural physical wear and tear of the product during normal use.
- For damages caused to the customer or for a delay in the delivery of the product, if the damage or the delay in the delivery of the product is due to a circumstance that HoiaMed OÜ could not influence or foresee.
- For side effects or allergic reactions, when using the product
Disagreements and disputes arising from the fullfillment of these conditions shall be settled by the parties, in particular through negotiations. If the disputes arising from the Agreement cannot be resolved through negotiations between the parties, the Customer has the right to apply to the Consumer Protection Board or the Court to protect their rights. HoiaMed OÜ has the right to apply to the Court to protect its rights.
